At the same time, we ensure that users have the opportunity to submit a counter-notification if they believe their content was removed or disabled by mistake.

Upon receiving a DMCA takedown notice, we carefully review it to confirm that it meets all statutory requirements. If the notice is valid, we will promptly remove or disable access to the allegedly infringing content. The uploader of the content will be notified and informed of their right to file a counter-notification if they believe the removal was incorrect.

Please note that the DMCA requires transparency. When you submit a takedown notice, we may provide a copy of your notice, including your contact details, to the individual who posted the material. This ensures that both parties can participate in a fair and lawful resolution of the dispute.

Requirements for a Valid DMCA Takedown Notice

To ensure your takedown notice is valid, it must include all of the following information:

• Identification of the copyrighted work that you claim has been infringed. For multiple works, a representative list is acceptable.
• Identification of the infringing content with sufficient detail to allow us to locate it on our site, such as exact URLs or file references.
• Your full legal name, mailing address, phone number, and email address.
• A statement confirming your good faith belief that the use of the content is unauthorized by the copyright owner, their agent, or the law.
• A statement made under penalty of perjury asserting that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

Once verified, the content will be removed or access restricted. The uploader will be informed and can respond with a counter-notification if they believe the removal was mistaken.

Submitting a Counter-Notification

If your content was removed or disabled and you believe this action was made in error, you may submit a counter-notice that includes:

• Identification of the material that was removed and its prior location on our platform.
• Your full name, address, telephone number, and email address.
• A statement, made under penalty of perjury, that you believe the removal was the result of mistake or misidentification.
• A statement consenting to the jurisdiction of the Federal District Court in your location, or if outside the U.S., any judicial district where the platform can be found.
• A statement that you will accept service of process from the person who filed the original DMCA notice or their agent.
• Your electronic or physical signature.

After receiving a valid counter-notification, we will forward it to the original complainant. If they do not file a legal action within 10 to 14 business days, the content may be restored at our discretion.

Legal Considerations

Knowingly submitting false information in a takedown notice or counter-notification is a violation of Section 512(f) of the DMCA and may result in civil liability, including damages and attorney’s fees. We urge all parties to submit claims and responses in good faith and with accurate information.
